1. Acceptance of Terms

By accessing or using UPGrade ("the Service"), operated by Albright Forge, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is available at upgrade.albrightforge.com.

2. Description of Service

UPGrade is a student life management platform that helps students track grades, assignments, calendar events, goals, journals, and more. The Service integrates with third-party platforms including Google Calendar, Google Classroom, and school information systems (such as Focus SIS) to provide a unified dashboard for academic management.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. By using UPGrade, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

• You may create an account using Google Sign-In, Apple Sign-In, or email/password registration.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate and complete information when creating your account.
• You agree to notify us immediately of any unauthorized use of your account.

5. Third-Party Integrations

The Service connects to third-party platforms to enhance your experience. By connecting these services, you acknowledge and agree to the following:

• Google Services: Access to Google Calendar and Google Classroom is read-only. We do not create, modify, or delete any data in your Google account. You can revoke access at any time through your Google Account permissions.
• Focus SIS: You provide your Focus SIS credentials voluntarily. These credentials are encrypted and stored securely. We access your SIS data only to display grades and assignments within UPGrade.
• Stripe: Payment processing is handled by Stripe Inc. Your use of Stripe is subject to Stripe's own terms of service.

6. Subscription and Payments

• UPGrade offers both free and premium subscription tiers.
• Premium features require a paid subscription managed through Stripe.
• Subscription fees are billed in advance on a recurring basis.
• You may cancel your subscription at any time through the Settings page.
• Refunds are handled in accordance with our refund policy and applicable law.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Upload or transmit malicious code, viruses, or harmful content
• Impersonate any person or entity, or misrepresent your affiliation
• Use the Service to harass, bully, or harm other users
• Scrape, data-mine, or extract data from the Service through automated means

8. User Content

You retain ownership of content you create within UPGrade (journal entries, goals, events, etc.). By using the Service, you grant us a limited license to store and display your content solely for the purpose of providing the Service to you. We do not claim ownership of your content and will not use it for any purpose other than operating the Service.

9. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Albright Forge and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for the accuracy of data obtained from third-party integrations (Google, Focus SIS, etc.).

11. Limitation of Liability

To the fullest extent permitted by law, Albright Forge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified terms.
